LIMITS OF CONFIDENTIALITYThe contents of all therapy sessions are considered confidential. Both verbal information and written records related to a client will not be disclosed to any third party without the client’s written consent or the consent of the client’s legal guardian, except in the following circumstances:
Duty to Warn and Protect
If a client expresses intent, plan, or means to harm another individual, the mental health professional is legally and ethically required to take appropriate action, which may include warning the intended victim and notifying law enforcement authorities. If a client expresses or implies intent to harm themselves (including suicidal ideation or intent), the professional is required to take reasonable steps to ensure safety, which may include contacting emergency services and/or notifying family members or designated supports.
Abuse of Children and Vulnerable Adults
If a client discloses or suggests current or past abuse, neglect, or imminent risk of harm to a child or vulnerable adult, the mental health professional is mandated to report this information to the appropriate child protective services and/or legal authorities as required by law.
Prenatal Exposure to Controlled Substances
Mental health professionals are required to report any admitted prenatal exposure to controlled substances that may pose a risk of harm to an unborn child, in accordance with applicable legal and ethical reporting requirements.
